Terms of Service

These Terms of Service ("Terms") are an agreement between you and nanny nearest ("nanny nearest," "we," "us"). They govern your use of the nanny nearest iOS app and this website (together, the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Service.

1. What nanny nearest does

nanny nearest helps parents find another family to share a nanny with, for example one family needing mornings and another needing afternoons. We show you nearby families whose schedules complement yours and let you message families you've connected with.

We are an introduction and messaging platform only. We are not a nanny agency, employer, staffing or childcare provider. We do not employ, screen, vet, verify or background-check any family or nanny, and we are not a party to any arrangement you make with another family or with a nanny.

2. Eligibility and your account

• You must be at least 18 years old and a parent or legal guardian, or otherwise legitimately looking for shared childcare for your family.
• Provide accurate information and keep it up to date. Create only one account for your family.
• Keep your password secure. You're responsible for activity on your account. Tell us promptly at support@nannynearest.com if you think it has been compromised.

3. Your responsibility for childcare decisions

Any arrangement you make is between you and the other family and nanny. You are solely responsible for deciding whether to connect with, meet or share care with anyone. This includes:

• verifying identity and references, and running background checks, on any nanny or family you choose to work with;
• complying with employment, tax, wage-and-hour, insurance, licensing and other laws that apply to hiring a nanny, including household-employer obligations;
• agreeing in writing who pays, who employs, and how schedules, costs, illness, liability and ending the arrangement are handled;
• using caution when sharing personal information and when meeting in person. We suggest meeting in a public place first.

Match scores, schedule overlap and distances are estimates to help you decide. They are not a recommendation, endorsement or guarantee that a family or arrangement is suitable or safe.

4. Acceptable use

You agree not to:

• harass, threaten, abuse, discriminate against or defraud anyone, or send spam or unsolicited promotions;
• post anything false, misleading, unlawful, sexually explicit, or that infringes someone's rights;
• impersonate anyone or misrepresent your family, schedule, location or nanny status;
• use the Service to find or contact people for any purpose other than shared childcare;
• collect or scrape information about other users, or use it for anything other than evaluating a childcare arrangement;
• interfere with, probe or attempt to break the security of the Service, or access it by automated means;
• use the Service in violation of any law or to harm a child.

5. Messages and content

You own the content you submit, such as your profile details and messages. You give us a limited, non-exclusive license to host, store, transmit and display that content solely to operate and improve the Service, enforce these Terms and handle reports. Other families can see the profile details described in our Privacy Policy and the messages you send them in chat. You're responsible for your content and confirm you have the right to share it.

6. Blocking, reporting and enforcement

You can block or report another family from a chat. When you report a family, we keep a copy of the conversation to review it. We may investigate reports and may warn, suspend or remove accounts or content, or refuse service, at our discretion and without notice, including for violations of these Terms, safety concerns or legal reasons. If you believe your account was removed in error, email support@nannynearest.com.

7. Ending your account

You can delete your account at any time in the app under Profile → Delete account; see Account Deletion. We may suspend or terminate your access as described above. Sections that by their nature should survive termination (including 3, 8, 9, 10 and 11) will survive.

8. Our rights

The Service, including the nanny nearest name, logo, app design, matching logic and software, is owned by us and protected by law. We grant you a limited, personal, non-transferable, revocable license to use the app on devices you own or control for its intended purpose. You may not copy, modify, reverse engineer or resell the Service except as the law allows. If you send us feedback or suggestions, we may use them without obligation to you.

9. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't warrant that the Service will be uninterrupted, secure or error-free, or that you will find a match. We make no promises about the identity, conduct, reliability, qualifications or intentions of any user or nanny.

10. Limitation of liability

To the fullest extent permitted by law, nanny nearest and its owners, officers, employees and affiliates will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data or goodwill, arising from your use of the Service. We are also not liable for the acts or omissions of any user, family or nanny, or for any injury, loss or damage arising from interactions or arrangements between users, whether online or in person. Our total liability for any claim relating to the Service will not exceed the greater of $100 or the amount you paid us in the 12 months before the claim. Some places don't allow certain limits, so parts of this section may not apply to you.

11. Indemnity

To the extent permitted by law, you agree to defend and indemnify nanny nearest against claims, losses and expenses (including reasonable legal fees) arising from your content, your violation of these Terms or the law, or your dealings with other users or nannies.

12. Changes to the Service or Terms

We may change, suspend or discontinue any part of the Service. We may update these Terms from time to time. If we make material changes, we'll post the new version here with an updated date and, where appropriate, notify you in the app or by email. Continuing to use the Service after changes take effect means you accept them.

13. General

These Terms and our Privacy Policy are the entire agreement between you and us about the Service. If a provision is found unenforceable, the rest remains in effect. Our not enforcing a provision isn't a waiver. You may not transfer your rights under these Terms; we may transfer ours in connection with a merger, sale or reorganization. The Service is intended for use in the United States. Apple isn't a party to these Terms and has no obligation to provide support for the app; if you downloaded the app from the App Store, Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
